Terms of Service

1. The deal

By downloading, installing, or using SideQuestr, you agree to these Terms. If you don’t agree, please don’t use the app. SideQuestr is operated by Samuel Schoettker as a solo developer (“we”, “us”). How we handle your data is covered separately in our Privacy Policy, which is part of this agreement.

2. What SideQuestr is

SideQuestr is a map of places and events, built mostly by the people using it. You can add spots, list events, check in when you actually go somewhere, write reviews, vote on things, save places for later, commit to plans, add friends, and share spots and events with them — publicly, or privately by invite link.

Almost everything on the map is user-generated. We don’t verify that a spot exists, that its hours or prices are right, that an event is happening, or that a review is honest. Treat it like advice from a stranger, because often it is.

3. Your account

You’re responsible for your account. Don’t share your credentials, don’t let other people post as you, and be honest about who you are. You must be at least 13 years old to use SideQuestr. One person, one account — don’t run multiple accounts to evade a suspension, stack votes, or inflate anything.

4. Acceptable use

Don’t use SideQuestr to:

• Harass, threaten, stalk, or abuse other users.
• Post content that’s illegal, hateful, violent, sexually explicit, or otherwise objectionable under the App Store guidelines.
• Post someone’s home, workplace, or any private location, or any personal information about someone, without their clear permission.
• Spam, flood, mass-invite, or otherwise disrupt the experience for other users.
• Scrape, crawl, bulk-download, or reverse-engineer the app, the map data, or our services.
• Impersonate anyone else, or misrepresent your affiliation with a business or place.
• Spoof your GPS to fake visits or check-ins. Visit verification is core to the app — cheating it is grounds for immediate suspension.
• Manipulate reviews, votes, or attributes — no fake reviews, no paid reviews, no vote rings, no reviewing your own business, no burying a competitor.
• Use the app for commercial promotion of a business you’re tied to without disclosing it, or to sell anything to other users.
• Probe our access controls, or try to read data you weren’t granted — including private spots and events you weren’t invited to.

5. Zero tolerance for objectionable content and abusive users

There is no tolerance for objectionable content or abusive behavior on SideQuestr. Concretely:

• Every spot, event, review, photo, and user profile can be reported from inside the app.
• You can block any user. Blocking cuts them out of your experience in both directions.
• Uploaded images are scanned automatically before they go live, and content that draws repeated reports is hidden automatically pending review.
• We review reports of objectionable content and act on them — removing the content, and suspending or terminating the account behind it — within 24 hours.

If you see something that violates these Terms, report it in the app or email sidequestr.support@gmail.com.

6. Your content

You own what you upload — spots, events, photos, captions, reviews, everything. You’re responsible for it, and you confirm you have the right to post it, including any rights in photos you didn’t take yourself and the consent of people who appear in them.

By uploading, you grant SideQuestr a non-exclusive, worldwide, royalty-free license to host, display, distribute, and adapt that content solely for the purpose of operating and promoting the app. You can delete your content at any time, and that license ends when you do — with the two exceptions below.

• Spots and events survive account deletion. When you delete your account, the spots and events you posted stay on the map, unlinked from you. Other people have visited, saved, and reviewed them, and pulling them would break the map for everyone else. The license above continues for that content. If you want a specific spot or event gone rather than orphaned, delete it in the app before deleting your account, or email us and we’ll remove it.
• Feedback quotes you approve. If you leave in-app feedback and tick the box allowing us to share it, you’re giving us permission to quote it publicly — on our website, in the App Store, or in marketing. Leave the box unticked and we won’t. Change your mind any time by emailing us.

7. Reviews, votes, and check-ins

Reviews should be your honest, first-hand experience. You get one visible review per spot and per event. Votes on spots, events, and other people’s reviews are for signal — not for punishing people you don’t like.

Check-ins are verified against your GPS location. Automatic visit detection is best-effort and depends on iOS, your permissions, and your device — it will sometimes miss a visit or log one you’d rather it hadn’t. You can turn it off at any time in iOS Settings.

8. Private spots, events, and invite links

You can mark a spot or event private. Private items are visible to you and to anyone who opens your invite link — and once someone has that link, they can unlock the item, and they can pass it on. Share invite links deliberately. We can’t un-share a link that’s already out, and marking something private is not a substitute for not posting it in the first place.

9. Notifications

SideQuestr sends push notifications about friends, plans, and your own content, plus local reminders before events you commit to. You can turn categories off in the app and turn everything off in iOS Settings. Cancellation notices for plans you committed to are treated as time-sensitive and may still be delivered, because a cancelled plan you show up to is worse than an unwanted notification.

10. Promoted content

You may see promoted spots or deals in the feed. These are curated by us and clearly presented as part of the feed. There’s no third-party ad network in the app, and promoted content is not targeted using your personal data.

11. Moderation and enforcement

We may remove content that violates these Terms or the App Store guidelines, and we may hide, suspend, or terminate accounts that violate them. Some of this is automated: image scanning on upload, and automatic hiding of content that reaches a report threshold. We try to be reasonable, but the final call is ours.

If you think we got it wrong, email sidequestr.support@gmail.com from the address on your account and we’ll take another look.

12. Third-party services

SideQuestr is built on top of Supabase, Mapbox, Google (Places and sign-in), Apple (Sign in with Apple, the App Store, and push notifications), PostHog (analytics), and OpenAI (automated image moderation). Your use of the app is also subject to those providers’ terms. Links, tickets, and venue information may take you to third-party sites we don’t control and aren’t responsible for.

13. No warranty, and your safety

SideQuestr is provided “as is” and “as available”. We don’t guarantee that spot or event information is accurate, that a place is open, safe, legal to enter, or suitable for you; that check-in detection works every time; or that the service will be uninterrupted.

Use your own judgment. You’re responsible for your own safety when you visit a place you found in the app or meet someone through it. Don’t trespass, don’t go somewhere unsafe because a stranger rated it highly, and don’t rely on SideQuestr in an emergency — it is not an emergency service and cannot summon help.

14. Limitation of liability

To the maximum extent allowed by law, SideQuestr’s total liability to you for any claim arising from the app is limited to the greater of $100 USD or the amount you paid us in the 12 months before the claim. (SideQuestr is free, so that’s typically $0.) We’re not liable for indirect, incidental, or consequential damages, or for anything that happens to you at a place you found through the app or with a person you met through it.

15. Indemnity

If someone brings a claim against us because of content you posted or how you used the app, you agree to cover our reasonable costs in dealing with it.

16. Termination

You can stop using SideQuestr and delete your account at any time from Settings → Account → Delete Account. We can also suspend or terminate accounts that violate these Terms. Sections that by their nature should survive termination — the content license for spots and events that remain on the map, approved feedback quotes, liability, indemnity, and governing law — survive.

17. Changes to these Terms

We may update these Terms. When we do, we’ll bump the date at the top of this page, and material changes will be called out in-app. Continuing to use SideQuestr after a change means you accept it.

18. Governing law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to that venue.

19. Apple

This agreement is between you and us, not Apple, and Apple isn’t responsible for the app or its content. Apple has no obligation to provide support for SideQuestr. Apple is a third-party beneficiary of these Terms and may enforce them against you. You confirm you’re not located in a country subject to a US embargo or designated as terrorist-supporting, and that you’re not on any US list of prohibited or restricted parties.
